Regulation & Availability
KuCoin pleaded guilty in the U.S. in January 2025 (settling for over $297M) and exited the U.S. market for at least two years. In Europe it holds an Austrian MiCA license (November 2025, passported to 29 EEA markets), but the Austrian FMA restricted new EU customer onboarding in February 2026 over AML staffing; KuCoin rebuilt the team by April 2026 and awaits a formal lift.
Binance is the world's largest exchange by volume. Its MiCA position remains unresolved as of mid-2026 — in the EEA it lists USDC-margined futures (USDC being MiCA-compliant e-money) rather than the USDT-margined contracts offered elsewhere. Practical bottom line: availability is regional for both — check what each exchange actually offers for your country before funding an account, and never keep more on any exchange than you can afford to.
Fees in Practice
On paper both start at 0.10% spot. In practice a fee-token user pays 0.075% on Binance (BNB, 25% off) vs 0.08% on KuCoin (KCS, 20% off) — a wash for most traders. Futures is where Binance edges ahead: 0.02%/0.05% base vs KuCoin's ~0.02%/0.06%, and BNB shaves another 10% off. What moves the needle more than either headline rate is slippage: on thin small-caps, Binance's deeper books often make the all-in cost lower even at an identical fee — while for coins Binance simply doesn't list, KuCoin is the market you get.

Derivatives & Leveraged Products — Important Risk Warning
Derivatives are complex financial instruments that carry a high risk of rapid capital loss. Leveraged trading (futures, perpetual contracts, margin trading, options) can result in losses that exceed your initial investment. The majority of retail investor accounts lose money when trading derivatives.
You should carefully consider whether you understand how derivatives work and whether you can afford to take the high risk of losing your money. This content is for educational purposes only and does not constitute financial advice, investment advice, or a recommendation to trade derivatives.
In the European Union, crypto derivatives are classified as financial instruments under MiFID II. Only platforms with appropriate MiFID II authorization may offer these products to EU residents. Regulatory treatment varies by jurisdiction — verify the legal status of derivatives trading in your country before participating.
